11. Arbitration & Class Action Waiver
Please read this section carefully — it affects how disputes are resolved and limits your rights. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding. This applies to all claims, including without limitation any claim under the Telephone Consumer Protection Act (TCPA) or relating to calls or text messages.
30-day opt-out. You may opt out of this Section 11 by emailing info@instantcashoffergenerator.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms; opting out will not affect the rest of these Terms. If the class-action waiver is held unenforceable as to a particular claim, only that claim shall proceed in court and the remainder of this Section stays in effect. This Section survives termination.
12. Changes to Terms
We may update these Terms and will revise the effective date above. Continued use after changes constitutes acceptance.
13. Third-Party Trademarks
Zillow, Redfin, and any other third-party names or trademarks are property of their respective owners. References are nominative fair use only. ICOG is not affiliated with, endorsed by, or sponsored by any third-party real estate platform.
14. General Provisions
Entire agreement. These Terms, together with our Privacy Policy and any separate written agreement you enter with us, are the entire agreement between you and ICOG regarding the Site and supersede any prior understandings on that subject.
Severability. If any provision of these Terms is held unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.
Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, outages, network or third-party vendor failures, labor disputes, or government action.
Electronic communications & consent (E-SIGN). You consent to receive communications and records from us electronically, and you agree that electronic communications, agreements, signatures, and records satisfy any legal requirement that such communications be in writing.
